GENERAL TERMS AND CONDITIONS

SCOPE AND BRAND PRESENCE These General Terms and Conditions (T&Cs) apply to all cultural events, concerts and tours (e.g. Flamenco, Jazz, Neoclassical, Tribute Shows) organised by Dabo Eventos S.L. The promotion, transaction and brand presence of the events are carried out exclusively under the registered brand BD PRODUKTION (part of the BD Events Group). By purchasing or using a ticket, the customer fully accepts the validity of these T&Cs.

  1. CONTRACTUAL PARTNER AND TICKET DISTRIBUTION (PRETIX / EVENTIM / EVENTIM.LIGHT) Contractual partner: The contract for attending the event is concluded exclusively between the customer (purchaser/holder) and Dabo Eventos S.L. Direct distribution via Pretix: Insofar as tickets are purchased directly via the widget or the website of BD PRODUKTION (ticketing system Pretix u2013 rami.io GmbH), Dabo Eventos S.L. is the direct contractual partner and ticket issuer. Distribution via external platforms (Eventim / Eventim.Light / Reservix): If the ticket purchase is processed via external ticket portals, the terms and conditions and privacy policies of the respective ticket distribution service provider apply in addition to these Event Organiser T&Cs.

  2. NO RIGHT OF CANCELLATION FOR TICKET PURCHASES Important legal notice: Pursuant to Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB), there is no right of cancellation for contracts relating to the provision of services in connection with leisure activities that provide for a specific date or period (such as concert or event tickets). Every ticket order is therefore binding immediately upon confirmation by us or the ticket provider and obliges the customer to accept and pay for it. An exchange or return for personal reasons is excluded.

  3. YOUTH PROTECTION AND ENTRY REGULATION FOR CHILDREN Minimum age: As a general rule, children are only permitted to attend our events from the age of 6. Mandatory accompaniment (minors): Children and young people aged between 6 and 16 may only attend events when accompanied by a person with parental authority (mother, father or guardian) or an adult authorised to exercise parental control (in accordance with the Youth Protection Act). Persons authorised to exercise parental control must be in a position to actually exercise supervision. Mandatory identification: It is mandatory for all concert-goers (including accompanying persons) to carry a valid official photo ID (ID card or passport; a student ID is not sufficient) in order to prove their age during checks.

  4. CANCELLATION, RESCHEDULING OR SEAT REALLOCATION Cancellation (Annulment): In the event of a cancellation of the event without a replacement, the customer is entitled to a refund of the face value printed on the ticket (ticket price excluding booking, transaction or system fees). The reversal is processed automatically or upon application via the respective sales channel (Pretix, Eventim, etc.). The organiser undertakes to process the refund using the payment method originally used within a statutory period of 14 days from the official cancellation date or from receipt of the customer's refund request. Any further claims for damages (e.g. for travel or hotel costs) are excluded, unless the organiser caused the cancellation intentionally or through gross negligence.

Rescheduling (postponement to a new date or location): If an event is postponed to a different time or location, the tickets already purchased automatically remain valid for the replacement date; an exchange is not required. The organiser will inform customers of the postponement immediately via the communication channels specified during the ticket purchase (in particular by email). Should attending the replacement date be unreasonable or impossible for the customer, they have the right to cancel the ticket and demand a refund of the ticket price (face value). The customer must assert this right to a refund in the event of a postponement against the organiser or the respective ticket agency within a period of 14 days after the postponement was announced, but in any case no later than the start of the actual replacement date. After this 14-day period has expired, the right to a refund lapses, unless the customer proves that they were not responsible for their failure to comply with the deadline. Payment of the refund amount will also be made within 14 days of successful assertion.

Programme Changes & Support Acts: We reserve the right to make minor changes to the programme, the cast or the support acts for organisational or artistic reasons. This does not entitle the customer to withdraw from the contract or to a price reduction.

Seat Reallocations: The organiser reserves the right to reallocate seats to equivalent seats within the venue for production-related or official regulatory reasons.

  1. ADMISSION CONTROL, SECURITY AND HEARING PROTECTION Security Checks: Upon admission, a check of the ticket (barcodes/QR codes) and a security search of the visitor and their bags will take place (including body search). The instructions of the security staff must be followed. Prohibited Items: Carrying glass or plastic containers, cans, pyrotechnic objects, torches, weapons, bulky items or other dangerous tools onto the event premises is strictly prohibited. Non-compliance will inevitably result in immediate expulsion from the event premises without a ticket refund. Loss of Validity: The admission ticket loses its validity immediately upon leaving the event premises (validation area). If the admission ticket is lost, the right of admission is completely void. Delayed Admission: In order not to disturb the artistic performance, there is no entitlement to immediate admission in the event of late arrival after the start of the performance. Admission will only be granted at a suitable time determined by the admission staff (e.g. during an intermission). Hearing Protection Notice: Due to the volume at music events, there may be a risk of potential hearing and health damage. The organiser has no influence on the artistic volume of the artists and strongly recommends carrying personal hearing protection devices.

  2. ACCESSIBILITY AND ACCOMPANYING PERSONS Due to structural and official regulations of the respective venues, seats for wheelchair users and severely disabled persons are only available in limited numbers. An entitlement to a free ticket for an accompanying person only exists if the severely disabled card displays the mark "B" (necessity of constant accompaniment). The purchase of wheelchair user and accompanying person tickets must be processed in advance via our customer service (tickets@bdproduktion.de) or the designated channels of the ticket partners. For safety reasons, admission with regular tickets in a wheelchair may be refused if the special spaces at the venue are already fully occupied.

  3. AUDIO AND VIDEO RECORDINGS Professional audio, photo and video recordings during the performance are strictly prohibited for copyright and ancillary copyright reasons. Bringing audio recording devices of any kind as well as photo or video cameras is not permitted. Misuse or attempted misuse will be prosecuted. The visitor agrees that photo, video and audio recordings may be made during the event for documentation, press and advertising purposes of the BD Events Group (Art. 6 Para. 1 lit. f GDPR).

  4. PROHIBITION OF COMMERCIAL RESALE & CONTRACTUAL PENALTY Private Use: The purchaser bindingly guarantees to use the admission ticket(s) exclusively for private purposes. Any commercial or business resale of the purchased admission tickets without the prior written consent of the organiser is prohibited. Price Cap on Private Resale: The private resale of admission tickets at a price higher than the printed ticket price (face value) plus fees actually charged is prohibited. Contractual Penalty: If the purchaser violates the prohibitions on commercial resale or overpriced private resale, they are obliged to pay a contractual penalty to the organiser in the amount of EUR 2,500.00 for each individual violation. In addition, the organiser reserves the right to exclude these persons from purchasing tickets in future. Prohibition of Deception: Preparing or modifying the admission ticket for the purpose of deception is prohibited.

  5. TRAVEL, PARKING AND LIMITATION OF LIABILITY Travel at Own Risk: Travel to the venue and parking are at your own risk. There is no entitlement to a parking space directly at the venue. The organiser is not liable for damaged, lost or stolen items belonging to visitors. Limitation of Liability: We accept unlimited liability for damage resulting from injury to life, body or health based on an intentional or negligent breach of duty by us or our vicarious agents. For other damages, we are only liable in cases of intent or gross negligence. In the event of a breach of material contractual obligations, liability is limited to typical, foreseeable contractual damage.

  6. FINAL PROVISIONS The law of the Federal Republic of Germany applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these T&Cs be or become invalid or unenforceable, the validity of the remaining provisions of the contract remains unaffected (Severability Clause). Statutory regulations apply instead of the invalid provision.
